Darallax provides web design, web hosting, e-commerce development, email solutions, domain registration, and technical support services. All services are subject to these terms and any additional agreements made in writing.
Project fees are due as outlined in your individual quote or invoice. Hosting, domain, and recurring service fees are due on the dates specified. Late payment may result in suspension of services. All fees are non-refundable unless otherwise agreed in writing.
Upon receipt of full payment, ownership of the final website design and custom code transfers to you. Darallax retains the right to display completed work in our portfolio. Third-party assets, fonts, and libraries remain subject to their respective licences.
You are responsible for providing accurate content, timely feedback, and required materials. Delays caused by client-side inaction may affect timelines. You warrant that all content provided does not infringe third-party rights.
We target 99.9% uptime for hosted services. Scheduled maintenance and events beyond our control (including third-party infrastructure failures) are excluded from this commitment. We are not liable for losses arising from unavoidable downtime.
Darallax's liability for any claim is limited to the fees paid for the specific service giving rise to the claim. We are not liable for indirect, consequential, or incidental damages of any nature.
Either party may terminate recurring services with 30 days' written notice. We reserve the right to suspend or terminate services immediately for breach of these terms or non-payment.
These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of South African courts.
